Consulting companies will not be able to supervise construction sites

Supervisory companies will not be able to conclude testing contracts in the laboratories of the builder or related parties, provide for legal changes.

Consulting companies will not be able to supervise construction sites if they or their related entities and companies are builders and / or suppliers of machinery, equipment and equipment for those sites.

This is envisaged by new proposals for amendments to the Spatial Planning Act, proposed by the Ministry of Regional Development and Public Works. The texts have been published for discussion on the public consultation portal. The deadline for submissions is 25 October.

The department also suggests that construction supervision companies cannot conclude testing contracts in the laboratories of the builder or related parties.

With the changes being accepted, the consultants will not be able to conclude a contract to evaluate the conformity of the construction project, for which they or their employees are designers and/or builders, and/or suppliers of machinery, equipment, technological equipment, and related with the persons within the meaning of the Trade Law.

The rules for terminating the validity of a certificate of conformity for the investment projects and/or exercising construction supervision by a sanctioned consultant are also tightened. This will be the case for two criminal decrees and will require non-infringement for a period of three years.

The sanctions for the persons who carry out an assessment of the conformity of an investment project in violation of the requirements of the law are also increasing. Depending on the violation, the sanctions could reach BGN 15,000.
